SpeakingSuccess is a brand within Delaney & Hart Limited. All additional website URLs used by Celia Delaney fall under the trading scope of Delaney & Hart Limited.

Refunds Policy
All one-time digitally downloadable products will qualify for 100% refund within 30 days where a reasonable reason for the refund is stated. The purchaser must delete the material off his/her hard drive at the point of refund.

All continuity programs (whereby the material is delivered sequentially over
a specified period of time, whether digitally or otherwise) may be terminated at
any time, with no recourse. No further payments will be taken after
cancellation. There will be no refund given for the parts of the program already
delivered.

All coaching and mentoring, whether delivered via telephone, online, via
email, or face-to-face, is non-refundable.

Copyright and Trademark Law
All editorial content and
graphics on this site are protected by copyright and international treaties and
may not be copied or re-used without the express written permission of this
site, which reserves all rights.

Warranties and Liability
Except in respect of death or
personal injury caused by Delaney & Hart’s negligence, or as expressly
provided in these Terms, Delaney & Hart shall not be liable to the Client
for any representation (unless fraudulent), or any implied warranty, condition
or other term, for any duty at common law, for any loss of profit or any
indirect, special or consequential loss, damage, cost, expenses or other claims
(whether caused by the negligence of Delaney & Hart, its agents or employees
or otherwise) which arise out of or in connection with provision of Services or
their use by the Client.

None of the information supplied by Delaney & Hart or any of its
subsidiary brands constitutes therapy in any form.

It is accepted that most results which Delaney & Hart clients may have as
a result of any of the products, programs, or services supplied through Delaney
& Hart are not typical of what you may achieve. All outcomes are entirely
dependent on how hard you work, and how you choose to apply yourself and the
information – in fact it is impossible to state a typical outcome, as everyone’s
results will vary. You may not make back the cost of the said products, programs
and services. This is a risk you must accept.

This site provides the information, services and products on this website ‘as
is’ without warranties of any kind. You also agree that this site shall not be
responsible for any content found on this site and that your use of this site
and any downloading of materials found on or throughout this site is done at
your own risk and that you will be solely responsible for any damages to your
computer or data that results.

All express warranties and all implied warranties, including without
limitation warranties of merchantability and fitness for a particular purpose,
and non-infringement of proprietary rights are hereby disclaimed to the full
extent permitted by law. This site does not warrant that the use or performance
of this website will be timely, uninterrupted or free of error, or that this
website or its server will be free of viruses. In no event shall this site, its
officers, directors, agents and employees be liable for any loss or injury,
direct or indirect, incidental, consequential, special or exemplary damages, or
any damages whatsoever arising from the use or performance of this website or
from any information, services or products provided through this website even if
this site has been advised of the possibility of such damages in the event that
applicable law prevents the exclusion of liability for certain warranties, such
exclusion does not apply to you to the extent limited by law.

Force Majeure
Delaney & Hart shall not be held in
breach of any of its obligations under the Terms to the extent only that due
performance or observance of such obligation is prevented, hindered or delayed
by reason of act of God, war and other hostilities, civil commotion, acts or
restrains of Government, or any other cause not within the reasonable control of
Delaney & Hart.

Delaney & Hart will notify the Client with the minimum of delay of any
circumstances arising from Force Majeure which materially affects its ability to
deal with the commission as contractually agreed.

General
This Agreement shall be governed by and
interpreted in accordance with laws of England and Wales and the parties hereby
submit to the non-exclusive jurisdiction of the English Courts.

This agreement does not affect any statutory rights.

Confidentiality
“Confidential Information’ means all
information of whatsoever nature (whether or not in writing) and whether eye
readable, machine readable or in any other form consisting of nature or in the
nature of intellectual property of any kind and relating wholly or partly to the
documentation which supplied to Delaney & Hart or to which it or Delaney
& Hart are allowed access or which it or Delaney & Hart otherwise obtain
and also includes all copies of any such information and whether in hard copy
form, or stored in any computer or other information retrieval system.

All Confidential Information shall be regarded as strictly confidential, and
shall remain the exclusive property of the Client, and accordingly shall not,
without prior specific approval be disclosed to any person.

Delaney & Hart will keep the Confidential Information safe in a secure
place and properly protected against theft, damage, loss and unauthorised access
(including, but not limited to, access by electronic means) and, without
prejudice to the foregoing, will take all reasonable steps to keep the same
confidential and exercise in relation to the Confidential Information no
information no lesser security measures and degree of care as it applies to its
own confidential information and all documents and other material reproducing or
incorporating any of the Confidential Information will be kept separate from
Delaney & Hart’s own information.

Delaney & Hart will not take or make copies of the Confidential
Information or any part of it, or authorise any other person to do unless
previously agreed by the Client. Delaney & Hart shall not acquire any
intellectual property or other proprietary rights in the Confidential
Information, whether pursuant to the assignment or otherwise.
